GallDiet Terms of Service

1. AGREEMENT TO TERMS

By downloading, installing, or using the GallDiet mobile application ("App") or accessing our website at https://galldiet.com ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or Website.

These Terms constitute a legally binding agreement between you and GallDiet ("we," "us," or "our"), operated by Caleb Oki.

IMPORTANT: Please read these Terms carefully. They contain important information about your legal rights, including limitations on liability, dispute resolution procedures, and medical disclaimers.

2. ELIGIBILITY

You must be at least 18 years old (or the age of majority in your jurisdiction) to use GallDiet. By using the App, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the App under applicable laws
• All information you provide is accurate and complete

If you are using GallDiet on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. MEDICAL DISCLAIMER

3.1 Not Medical Advice

GALLDIET IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE. The App is a general wellness and dietary tracking tool designed to help users monitor their food choices related to gallstone and digestive health.

3.2 No Doctor-Patient Relationship

Use of GallDiet does not create a doctor-patient relationship between you and GallDiet, its developers, or any affiliated parties. We are not healthcare providers.

3.3 Consult Healthcare Professionals

Always consult with qualified healthcare professionals before:

• Making any dietary changes
• Starting or stopping any treatment
• Making medical decisions related to gallstones or digestive health
• Interpreting symptoms or determining severity

3.4 Emergency Situations

If you are experiencing a medical emergency, call your local emergency services immediately. Do not rely on GallDiet for emergency medical guidance.

3.5 AI Limitations

Our AI-powered food analysis:

• May misidentify ingredients or foods
• Cannot detect hidden ingredients, allergens, or contaminants
• Provides general guidelines, not personalized medical recommendations
• Should not replace reading actual food labels
• Does not account for individual medical conditions, medications, or allergies beyond what you explicitly input

4. SUBSCRIPTION TERMS

4.1 Free and Premium Tiers

GallDiet offers:

• Free Tier: Limited features with basic food scanning and logging
• Premium Tier: Full access to all features, including unlimited scans, detailed pattern analysis, and recipe modifications

4.2 Subscription Pricing

Current Premium pricing:

• Monthly: $14.99 USD per month
• Yearly: $129.99 USD per year (approximately 28% savings)

Prices are subject to change with 30 days notice to existing subscribers.

4.3 Billing and Payment

• Payments are processed through Stripe, our third-party payment processor
• You authorize us to charge your selected payment method
• Subscriptions automatically renew unless cancelled
• You will be charged at the beginning of each billing period
• All prices are in USD and do not include applicable taxes

4.4 Cancellation

You may cancel your Premium subscription at any time:

• Through the App: Settings → Subscription → Cancel
• Through your device's app store (if subscribed via Apple/Google)
• By contacting support@galldiet.com

Cancellation takes effect at the end of your current billing period. You will continue to have Premium access until the period ends.

4.5 Refunds

• Monthly subscriptions: Generally no refunds for partial months
• Yearly subscriptions: Prorated refunds may be considered on a case-by-case basis within 14 days of purchase
• Contact support@galldiet.com for refund requests
• Refunds are processed through Stripe and may take 5-10 business days

4.6 Free Trials

If offered, free trials:

• Require payment method information
• Convert to paid subscription unless cancelled before trial ends
• Are limited to one per user/account

4.7 Price Changes

We may change subscription prices with 30 days advance notice to existing subscribers. Continued use after price changes constitutes acceptance.

5. USER ACCOUNTS

5.1 Account Creation

To use GallDiet, you must create an account with:

• A valid email address
• A secure password
• Accurate personal information (optional, but improves personalization)

5.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

5.3 Prohibited Activities

You agree not to:

• Share your account credentials with others
• Create multiple accounts to abuse free tier limits
• Use automated systems (bots, scripts) to access the App
• Attempt to reverse engineer, decompile, or hack the App
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users
• Violate any applicable laws or regulations
• Use the App for any illegal or unauthorized purpose
• Impersonate any person or entity

5.4 Account Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Misuse the App or its features
• Fail to pay subscription fees

You may delete your account at any time through Settings → Privacy → Delete Account. See our Privacy Policy for data retention details.

6. USER CONTENT

6.1 Your Content

"User Content" includes:

• Food photos you upload
• Health logs and symptom entries
• Attack reports and notes
• Profile information
• Any other content you submit to the App

6.2 Content License

By submitting User Content, you grant GallDiet a non-exclusive, worldwide, royalty-free license to:

• Store and display your content within the App
• Process photos through Anthropic Claude AI (or Google Gemini AI as fallback) for analysis
• Generate pattern insights and recommendations
• Create aggregated, anonymized datasets for App improvement

This license ends when you delete your account or the specific content.

6.3 Content Responsibility

You are solely responsible for your User Content. You represent that:

• You own or have rights to all content you submit
• Your content does not violate third-party rights
• Your content is accurate to the best of your knowledge
• Your content does not contain malware or harmful code

6.4 Photo Content Guidelines

When uploading food photos:

• Only upload photos of food/meals you have rights to share
• Do not upload photos containing other people without their consent
• Do not upload explicit, offensive, or illegal content
• Photos may be processed by third-party AI services (see Privacy Policy)

7. INTELLECTUAL PROPERTY

7.1 Our Intellectual Property

GallDiet and its content, features, and functionality are owned by Caleb Oki and are protected by:

• Copyright laws
• Trademark laws
• Patent laws (where applicable)
• Other intellectual property rights

You may not:

• Copy, modify, or create derivative works of the App
• Distribute, sell, or lease the App
• Reverse engineer or attempt to extract source code
• Remove copyright or proprietary notices
• Use our trademarks without written permission

7.2 Feedback

If you provide feedback, suggestions, or ideas:

• You grant us a perpetual, irrevocable, royalty-free license to use them
• We may implement them without compensation or attribution
• You waive any moral rights in such feedback

8. DISCLAIMERS AND LIMITATIONS

8.1 App Provided "As Is"

GALLDIET IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

8.2 No Warranty

We expressly disclaim all warranties, including:

• Accuracy: We do not warrant that food analysis results are accurate or complete
• Availability: We do not guarantee uninterrupted or error-free service
• Security: While we implement security measures, we cannot guarantee absolute security
• Results: We do not guarantee any specific health outcomes
• Third-Party Services: We are not responsible for Stripe, Anthropic Claude, Google Gemini, or other third-party services

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100 USD, whichever is greater
• We are not liable for damages resulting from:
  • Reliance on AI-generated food analysis
  • Health outcomes from dietary changes
  • Data loss or unauthorized access
  • Service interruptions or technical failures
  • Third-party services or integrations

8.4 Assumption of Risk

You acknowledge that:

• Using health tracking apps involves inherent risks
• AI analysis may produce incorrect results
• You use the App at your own risk
• You are responsible for verifying information with healthcare professionals

9. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless GallDiet, Caleb Oki, and our affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights
• Your reliance on App information for medical decisions

10. DISPUTE RESOLUTION

10.1 Informal Resolution

Before filing any claim, you agree to contact us at support@galldiet.com to attempt informal resolution. We will respond within 30 days.

10.2 Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.

10.3 Jurisdiction

Any legal action must be brought in the courts of Toronto, Ontario, Canada. You consent to the jurisdiction of these courts.

10.4 Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative actions.

10.5 Limitation Period

Any claim must be filed within one year of the event giving rise to the claim, or it is permanently barred.

10.6 Severability

If any provision of these Terms is found invalid, the remaining provisions remain in full effect.

11. CHANGES TO TERMS

We may modify these Terms at any time. Changes will be:

• Posted on this page with updated "Last Updated" date
• Notified via email or in-app notice for material changes
• Effective 30 days after posting (or immediately for non-material changes)

Material changes include:

• Changes to subscription pricing or refund policies
• New limitations on liability
• Changes to dispute resolution procedures
• Significant changes to data practices

Continued use after changes constitutes acceptance.

12. TERMINATION

12.1 By You

You may terminate these Terms by:

• Deleting your account through the App
• Ceasing all use of the App

12.2 By Us

We may terminate or suspend your access:

• Immediately for violations of these Terms
• With 30 days notice for any other reason

12.3 Effect of Termination

Upon termination:

• Your right to use the App ceases immediately
• Your Premium subscription continues until the end of the billing period (unless terminated for cause)
• Provisions regarding liability, indemnification, and dispute resolution survive termination

13. GENERAL PROVISIONS

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GallDiet.

13.2 Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

13.3 Assignment

You may not assign these Terms without our written consent. We may assign these Terms freely.

13.4 Headings

Section headings are for convenience only and have no legal effect.

13.5 Electronic Communications

By using the App, you consent to receive electronic communications from us.

13.6 Force Majeure

We are not liable for failures caused by events beyond our reasonable control (natural disasters, wars, internet outages, etc.).

13.7 Apple App Store Terms (iOS Users)

If you downloaded the App from the Apple App Store:

• These Terms are between you and GallDiet, not Apple
• Apple has no obligation to furnish maintenance or support
• Apple is not responsible for addressing claims related to the App
• Apple is a third-party beneficiary of these Terms

13.8 Google Play Terms (Android Users)

If you downloaded the App from Google Play:

• These Terms are between you and GallDiet, not Google
• Google has no obligation to furnish maintenance or support
• Google is not responsible for addressing claims related to the App
